Terms and Conditions
By Acquiring Digital Goods
By purchasing, downloading, accessing, or otherwise acquiring any digital goods, artwork, or
licenses from Melissa Williams and/or Tree Water Studio (“Tree Water Studio”), whether
through treewater.studio or any third-party platform, you acknowledge and agree to be bound
by these Terms and Conditions.
All digital goods are provided under a license-based model, meaning you are granted limited
rights to use the artwork in accordance with the applicable license, and no ownership of the
artwork is transferred to you. The governing license types include:
● Standard License: treewater.studio/licenses/standard
● Extended License: treewater.studio/licenses/extended
● Exclusive License: treewater.studio/licenses/exclusive
These Terms, together with the applicable license, constitute the single source of truth
regarding ownership, rights, and permitted use of all artwork.
Liability
To the fullest extent permitted by law, Tree Water Studio provides all digital goods, services, and
content on an “as is” and “as available” basis, without warranties of any kind, whether
express or implied. Tree Water Studio makes no representations regarding the accuracy,
reliability, or suitability of any artwork or service.
Tree Water Studio shall not be liable for any indirect, incidental, consequential, or special
damages, including but not limited to loss of profits, revenue, business opportunities, or data
arising from the use or inability to use any digital goods or services. Total liability, if any, shall be
limited to the amount paid for the specific license or product.
Delivery of Goods & Services
All products provided by Tree Water Studio are digital goods unless explicitly stated otherwise.
Delivery is considered complete when the digital product is made available to you via:
● Download link
● Email delivery
● Account access
● Third-party platform delivery systems
Tree Water Studio is not responsible for delivery failures caused by incorrect contact information
provided by the user or technical issues outside of its control.
Refunds Policy
Due to the nature of digital goods and immediate access upon delivery, all sales are final and
non-refundable, except where required by applicable law.
Tree Water Studio may, at its sole discretion, review and approve refund requests on a
case-by-case basis. Circumstances such as user error, lack of technical knowledge, or change
of mind do not constitute valid grounds for a refund.
Third-Party Links and Merchandise
Tree Water Studio may provide access to artwork through third-party platforms, marketplaces,
or external services. These platforms operate independently and are governed by their own
terms and policies.
Tree Water Studio does not control and is not responsible for:
● Third-party platform functionality
● External products or services
● Third-party data handling practices
Where applicable, third-party terms apply to transactions conducted on those platforms;
however, ownership, licensing intent, and intellectual property rights remain governed by
Tree Water Studio.
Copyright
All artwork, digital assets, and content created and distributed by Tree Water Studio remain the
exclusive intellectual property of Melissa Williams, unless otherwise expressly transferred in
writing.
By acquiring digital goods, you are granted a limited license to use the artwork, not
ownership of the artwork itself.
You may not:
● Reproduce, resell, or redistribute artwork outside the scope of the license
● Claim ownership or authorship
● Remove copyright or attribution notices
All rights not expressly granted are reserved.
Indemnity
You agree to indemnify, defend, and hold harmless Tree Water Studio and Melissa Williams
from and against any and all claims, damages, liabilities, losses, and expenses (including legal
fees) arising out of:
● Your misuse of artwork
● Your violation of these Terms
● Your infringement of any third-party rights
Breaches of These Terms of Use
If you breach any part of these Terms, Tree Water Studio reserves the right to:
● Suspend or terminate your access
● Revoke any licenses granted
● Pursue legal action where necessary
Unauthorized use of artwork may result in immediate termination of licensing rights and
potential legal consequences.
Assignment
You may not assign, transfer, sublicense, or otherwise distribute your rights under these Terms
or any granted license without prior written consent from Tree Water Studio.
Tree Water Studio reserves the right to assign or transfer its rights and obligations under these
Terms without restriction.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining
provisions shall remain in full force and effect.
Exclusion of Third Party Rights
These Terms do not confer any rights or benefits upon any third party. No person or entity other
than the parties to this agreement shall have any right to enforce any provision of these Terms.
Entire Agreement
These Terms and Conditions, together with the applicable license agreements and referenced
policies, constitute the entire agreement between you and Tree Water Studio.
They supersede all prior communications, agreements, or understandings, whether written or
oral.
Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of
Missouri, United States.
Any disputes arising from or relating to these Terms shall be resolved through appropriate legal
or arbitration processes within that jurisdiction.
Changes to These Terms
These Terms and Conditions are subject to change at any time without prior notice.
Tree Water Studio reserves the right to update, modify, or replace these Terms to reflect:
● Legal requirements
● Business operations
● Licensing structures
Updated versions will be posted on treewater.studio, and continued use of the website or
