Your right to use the Resources is subject to the terms below and is conditional upon payment
made to Melissa Williams for the applicable usage rights. Melissa Williams reserves the right to
update or amend these Terms and this License at any time.

This License Agreement (“License”) is a legally binding agreement between you (“Licensee” or
“you”) and Melissa Williams / Tree Water Studio (“Licensor,” “I,” or “my”) for downloading,
installing, or using the Brushes, Creative Tools, Tutorials, and Written Material (collectively
referred to as the “Resources”).

You acknowledge that all intellectual property rights in the Resources belong to Melissa
Williams, that the Resources are licensed and not sold, and that you have no rights to them
other than as expressly set out in this License.

By purchasing and downloading the Resources, you agree to be bound by the terms and
conditions of this License, including the limitations of liability set forth in Section 5. If you do not
agree to these terms, I cannot license the Resources to you and you must discontinue their use
immediately.

By purchasing the Resources from any of my online shops, you consent to the immediate
performance of the contract and acknowledge that you will lose your right of withdrawal once
the download or streaming of the digital content has begun.

 

Protected Works

All Brushes, Creative Tools, Tutorials, and Written Material are protected under the copyright
laws of the United States of America and applicable international intellectual property laws.
Melissa Williams retains all rights, title, and interest in and to the Resources, including all
copyrights, trademarks, and related intellectual property rights.

       1. Grant of License

          Upon valid purchase, the Licensor grants you a limited, non-exclusive, non-transferable,
          revocable license to use the Resources strictly in accordance with this Agreement.
          This License grants you permission to use the Resources but does not transfer ownership. All
          rights not expressly granted are reserved by the Licensor.

      2. Commercial Use

          You may use the Resources for commercial purposes provided that such use complies with this
          License.

          Permitted commercial use includes:

      ● Creating original artwork using the Resources
      ● Incorporating the Resources into personal or client projects
      ● Selling finished works that include the Resources as part of a larger, original composition

 

           You may not distribute the Resources in their original or extractable form.

      3. Personal Use

          You may use the Resources for personal, non-commercial purposes without limitation, provided
          that:

                ● The Resources are not shared or distributed
                ● The Resources remain under your control

       4. Restrictions

           You agree that you will NOT:

               ● Resell, redistribute, share, or sublicense the Resources
               ● Make the Resources available to others for download or use
               ● Use the Resources to create competing products (including brush packs, templates, or
                   toolkits)

     ● Claim ownership or authorship of the Resources
     ● Remove copyright notices or attribution
     ● Use the Resources in logos, trademarks, or branding without written permission
     ● Upload the Resources to marketplaces, file-sharing platforms, or repositories
     ● Reverse engineer, extract, or replicate the Resources
 

      5. Limitation of Liability

          To the fullest extent permitted by law, the Resources are provided “as is” without warranty of
          any kind, whether express or implied.

          The Licensor shall not be liable for any indirect, incidental, or consequential damages, including
          but not limited to:

                ● Loss of profits
                ● Loss of business
                ● Loss of data

          The total liability of the Licensor shall not exceed the amount paid for the Resources.

     6. AI / Machine Learning Use Prohibition

          You are strictly prohibited from using the Resources in connection with:

               ● Artificial intelligence training
               ● Machine learning datasets
               ● Generative AI systems
               ● Any computational system designed to learn from, replicate, or analyze the Resources

      This prohibition applies to all uses, whether personal or commercial.

7. Termination

     This License shall automatically terminate if you fail to comply with any of its terms.
     Upon termination, you must:

             ● Immediately cease all use of the Resources
             ● Delete all copies in your possession

     The Licensor reserves the right to pursue legal action for violations.
